Remove Thomas from the Bench: Step 4

Impeach Clarence Thomas

4th Step: Watch the newspapers for an article about Clarence Thomas or the Supreme Court. When you see one, write a letter to the editor, responding to the letter by title and date. Include a call for the US House of Representatives to investigation of Clarence Thomas. You might also mention the complaint filed with the Missouri Bar where Thomas is licensed (If you haven't, contact the MO Bar, See Below) .

If you want a chance for your letter to be published, most newspapers ask that you include your phone number so they can to verify you wrote the letter.

Some grist: Article III, Section 1 of the US Constitution says,

"The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behavior"

Which means judges can be removed for bad behavior. Clarence Thomas' bad behavior diminishes the credibility of our highest court, which contaminates the lower courts and erodes the public belief in the fairness of our society. This can lead to vigilante justice, which civil societies naturally strive to avoid. There in lies the rational; Clarence Thomas is a destabilizing force in our society hence it is in the national interest to ask Clarence Thomas to step down or be removed.

3rd Step: Contact US House of Representatives, the people's house. Ask for an investigation of Clarence Thomas. It won't happen soon, but it's our obligation to raise the issue (the right wing always does!).

A complaint has been filed with the Missouri Bar Association to investigate Judge Clarence Thomas for allegations regarding his taxes. Given other widely publicized partisan activities by Mr. Thomas, the association is being asked to measure the weight of broader evidence relative to rules of conduct for a lawyer.

I would like Congress to consider it's own investigation. Please add me to an interest e-mail list for people following your future investigations into this matter.

My Message:

I support the complaint filed with your association to investigation of Judge Clarence Thomas for allegations regarding his taxes. Given other widely publicized partisan activities by Mr. Thomas, the association has a solemn responsibility to relax the boundaries of its investigations. The Missouri bar must measure the weight of the broader evidence relative to rules of conduct for a lawyer, rules that should be more closely scrutinized for an exemplary member of society like a supreme court justice.

I received the following Reply from the Missouri Bar Assn:

"You need to contact the Commission of Retirement, Removal & Discipline of Judges, here is that telephone number 314-966-1007."

Not sure they can remove this judge!

Clarence Thomas is a Corporate Operative

I could go on and on about Clarence Thomas, but anyone reading this already should know that he is not acting in good faith. He is not a fair judge and he needs to go. How he got on to the US Supreme Court... well, we know that story too.

So, how do we do that? We know that when right-wingers want to get rid of someone, they have an uncanny way of making it happen (add list here). Part of it is access to more accumulated money (they are staunchly capitalistic). Part of it is access to levers of "the liberal media," which is closely related to the first point. But, in the end it often comes down to rabid numbers of right wing ditto-heads who pick up the phone, write letters and e-mails to bring about a sense of pressure.

Now it's our turn with Clarence Thomas. We can contact our members of the US House of Representative for starters and call for impeachment hearings. We can also contact media outlets asking that they invest more in the back story on and current unfolding stories on Thomas.

Target the Insider Democrats

Here is one perspective on why the Democrat Party leadership is giving George W. Bush a pass on his numerous crimes, and a strategy for doing something about it.

1. A small number of Democrats, in key leadership positions, were privy to classified briefings prior to the Iraq war. They were also informed, in advance, of Bush's warrantless domestic spying program and a number of other constitutional abuses.

2. Many of these abuses are felony crimes, which can be prosecuted outside of the congressional impeachment process. [See footnote on Vincent Bugliosi, author of "The Prosecution of George Bush for Murder."]

3. As witnesses with advanced knowledge, these insider Democrats might be legally liable for "tacit approval" of the Bush administration's crimes. Short of that, this hand full of Democrats are at risk to potential career-ending shame if the details of the Bush administration crimes get out.

4. Most of these same Democrat party leaders continue to control the Congressional agenda, including whether or not the Bush administration will be investigated. Most famously, one of them, Speaker of the House Nancy Pelosi, says no, "Impeachment is off the table."

5. The logic suggests that this small number of insider Democrats might be the blocking investigation of Bush due to fear of their own implication if the details were to come out.

6. If this small number of insider Democrats are blocking the investigation, then their removal from power would greatly increase the prospect of learning the details of Bush's crimes.

7. This suggests a political strategy. All of these Democrat insiders should be targeted for removal from office; it's a small group, therefore, the possibility of succeeding in their removal is within reason.

8. Cindy Shehan is an example of this strategy playing out. She is running against Speaker Nancy Pelosi.

9. Targets for removal include:
Jane Harmon (D-CA) the ranking Democrat on the Senate Intelligence Committee,
Sen. John D. Rockefeller IV (D-WV), the ranking Democrat on the Senate Intelligence Committee,
Nancy Pelosi (D-CA), House Minority Leader
Harry Reid (D-NV), Senate Minority Leader

Notes:

As an aside, Vincent Bugliosi has laid out a solid case that Bush, Rice and Cheney (maybe even Rove) are likely guilty of capital murder. The mock cross examination of Bush, who has to take the stand or looks guilty, is perhaps the best part of the book. Imagine the prosecutor's line of questioning leading Bush down a dangerous verbal path from which there is no escape... high pitched courtroom drama.

Preserve Right to Criminal Prosecution of Bush

For the next three weeks the blog takes to the road. Last time I did this I was exposed to the NYC Mentality.

OK. So there's a debate about the wisdom of impeaching Bush. I side with those who say Impeach Bush and Cheney to set the record straight for history, and to deter future Presidents from abusing power.

Despite Pelosi's "off-the-table" proclamation, the impeachment process is happening; that's because it is an organic process that unravels on it's own, just like the GOP support for the Iraq war is unraveling.

Politics is the art of the possible. The US House of Representatives should impeach Bush and Cheney with an explicit provision that the Senate need not act on the impeachment. This would avoid the question of double-jeopardy, thereby preserving the right to criminally prosecute Bush for capital offenses (See Update).

This is a win-win compromise for the progressive camps on both sides of the impeachment debate. It addresses the concerns of people like Senator Sherrod Brown who think Rove and others will exploit the situation by having the press say, "Give Democrats power, and see what they do with it? Spend time on vindictive acts rather than solving problems of the people."

The talk needs to turn to criminal prosecution of Bush Administration officials. Once we get Bush over the barrel, with capital punishment in play, then we can start talking about a grand compromise that will redistribute some of our stolen wealth.

HR 333 Impeach Dick Cheney

Congressman Dennis Kucinich's articles of impeachment against Dick Cheney provide a focal point for citizens to express their views about the corrupt Bush regime.

A Paraphrased Synopsis of the Articles of Impeachment

The articles of impeachment contend that each of Cheney's actions have undermined the national security of the United States.

Article 1 - False Claims of Iraqi WMD: Cheney purposefully manipulated the intelligence process to deceive the citizens and Congress by fabricating a threat of Iraqi weapons of mass destruction to justify the use of the US Armed Forces against Iraq.

Article 2 - False Claims of al Qaeda Connection to Iraq: Cheney purposefully manipulated the intelligence process to deceive the citizens and Congress about an alleged relationship between Iraq and al Qaeda to justify the use of the US Armed Forces against Iraq.

Article 3 - Threats of Aggression Against Iran: Cheney has violated his constitutional oath by openly threatening aggression against Iran absent any real threat to the United States.

The Court of Public Opinion Rules Impeachment

You might find some counter-points to right-wing talking points to be helpful:

1. "The threshold for impeachment is high." Not True. Laws need not be violated in order to justify impeachment. Do the actions undermine the government's credibility? Has the official failed to carry out constitutionally mandated duties? Does the American public want the official removed? That is sufficient to meet the threshold.

2. "Bush's term in office is nearly over." This is less about expelling Cheney from Office than it is about accountability. A citizen-based impeachment movement helps maintain the integrity of our country's principles, and deter abuses of future leaders.

3. "Impeachment would be a distraction of Congress." Bush and Cheney's abuses are so extreme that impeachment is warranted despite the distraction it would cause.

4. "Impeachment is inappropriate when our Nation is at war." The US is engaged in a chosen war of aggression in Iraq, founded on false pretenses, which are part of the charges against Bush and Cheney. The Bush administration has created an Orwellian war stance to boost their executive power. The "time-of-war" argument has no credibility in this case.

Gonzales: Nice Guy but Corrupt

It's a basic principle of our republic; the United States Justice Department and Attorney General represent the people, not the President. Attorney General Alberto Gonzales has shown a pattern of crossing that line, both personally and via actions of the Department. Now, the pressure is building for Gonzales to resign.

There is a petition drive to impeach Alberto Gonzales. According to former Nixon Attorney John Dean:

The Constitution's Impeachment Clause applies to all "civil officers of the United States" - not to mention the president, vice president and federal judges... the group certainly includes a president's cabinet and sub-cabinet, as well as the senior department officials and the White House staff (those who are issued commissions by the president and serve the President and Vice President).
The list of abuses is long, and the dark depths are chilling:

  • Creating a new legal category of humans: "Enemy Combatant."

  • Applying the principle of "guilt by association" in defining someone as an enemy combatant

  • Finding that the Geneva Conventions do not apply to this new category of humans.

  • Legalizing Torture for this new category of humans.

  • Legalizing kidnapping, international transport, detention and torture without legal representation.

  • Opening private mail without a warrant.

  • Massive program for sweeping up e-mails without warrants.

  • Surveillance of domestic phone calls without warrants.

  • FBI Abuse of the USA PATRIOT Act to obtain private records without warrants.

  • Firing U.S. prosecutors who posed political threats because they were honest.
